Terms & Conditions for BeLoved Asheville

1. Acceptance of Terms

By accessing or using the BeLoved Asheville assistance application platform ("Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Eligibility

To use this Platform and apply for assistance, you must:

• Be at least 18 years of age
• Reside within the BeLoved Asheville service area (Buncombe County / City of Asheville)
• Provide accurate and truthful information in your application
• Have a valid email address for account creation and communications

3. Application Process

Submitting an application does not guarantee approval or receipt of assistance. All applications are subject to review and verification by BeLoved Asheville staff. We reserve the right to request additional documentation or information at any time during the review process.

4. Accuracy of Information

You agree to provide accurate, current, and complete information when submitting an application. Providing false, misleading, or fraudulent information may result in:

• Denial of your application
• Revocation of any assistance previously granted
• Permanent disqualification from future assistance
• Referral to appropriate authorities if fraud is suspected

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. BeLoved Asheville is not liable for any loss or damage arising from your failure to protect your account information.

6. Document Uploads

By uploading documents to the Platform, you represent and warrant that:

• You have the right to share the documents submitted
• The documents are authentic and unaltered
• The documents are relevant to your application for assistance

We reserve the right to reject any documents that do not meet our requirements or appear to be fraudulent.

7. Assistance Limitations

BeLoved Asheville provides assistance on a case-by-case basis subject to available funding and program guidelines. Assistance is not an entitlement. We reserve the right to:

• Approve or deny applications at our discretion based on program criteria
• Limit the amount or frequency of assistance provided
• Modify program guidelines and eligibility requirements at any time
• Suspend or discontinue the assistance program without prior notice

8. Payment Terms

When assistance is approved, payments are made directly to landlords or vendors on behalf of the applicant. BeLoved Asheville does not provide cash payments directly to applicants. Payment processing times may vary and are subject to completion of all required documentation.

9. Landlord Participation

Landlords who participate in the assistance process agree to:

• Provide accurate information regarding the tenant's account
• Submit required documentation (W-9, invoices) in a timely manner
• Apply payments received to the specified tenant's account
• Not retaliate against tenants for seeking rental assistance

10. Intellectual Property

The Platform, including its content, features, and functionality, is owned by BeLoved Asheville and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written consent.

11. Limitation of Liability

To the fullest extent permitted by law, BeLoved Asheville shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any decisions made based on information provided through the Platform. Our total liability shall not exceed the amount of assistance, if any, provided to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless BeLoved Asheville, its officers, directors, employees, and volunteers from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Buncombe County, North Carolina.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
